COLUMBIANA – A 33-year-old Maylene man who has been indicted on a sexual abuse charge involving a juvenile is now facing a new felony charge after he allegedly received stolen property last summer.

The Pelham Police Department arrested Timothy Shane Lowery, who lists an address on Shelby County 260 in Maylene, on Nov. 4 and charged him with one felony count of first-degree receiving stolen property.

According to his arrest warrant, Lowery allegedly had possession of a 2004 Better Build dump trailer valued at $6,000 “knowing that it was stolen or having reasonable grounds to believe it had been stolen and not having the intent to restore it to its owner.”

The receiving stolen property charge came about two months after Lowery was indicted by a Shelby County grand jury on one felony count of first-degree sexual abuse. The indictment alleges Lowery did “intentionally subject to sexual contact another person … who was less than 12 years of age” between Jan. 1, 2004, and Jan. 1, 2005.

After the grand jury indicted Lowery, the Shelby County Sheriff’s Office took the suspect into custody and booked him into the Shelby County Jail on Sept. 12. Lowery was released from jail on Sept. 13 after posting a $25,000 bond, and was out on bond for the sexual abuse charge when he was arrested on the receiving stolen property charge.

Lowery originally was arrested by the Alabaster Police Department on Jan. 29 and charged with one count of sexual abuse of a child younger than 12. According to his arrest warrant, Lowery allegedly subjected a juvenile to sexual contact on Dec. 15, 2004.

He has pleaded not guilty to the sexual abuse charge, and is scheduled to appear in court for a status call on Nov. 30.

Lowery also was previously indicted on a felony second-degree theft of property charge on June 25 after he allegedly stole a 14-foot john boat valued at $1,500 on April 14.

As of Nov. 5, Lowery was being held in the Shelby County Jail on a $10,000 bond related to the receiving stolen property charge. First-degree receiving stolen property is a Class B felony, and is punishable by up to 20 years in prison upon conviction.

First-degree sexual abuse is a Class C felony, and carries a maximum sentence of 10 years upon conviction.
