BIRMINGHAM — Brookwood Medical Center will go to the Alabama Supreme Court with its case against allowing Trinity Medical Center to open a hospital on U.S. 280.

Brookwood attorney Jim Williams said system officials plan to file a petition on Friday, Jan. 25 with the state Supreme Court, appealing the Alabama Court of Civil Appeals decision.

On Jan. 11, the Alabama Court of Civil Appeals denied Brookwood Medical Center and St. Vincent’s Health System the chance to argue against Trinity Medical Center’s relocation to the now-vacant former HealthSouth building on U.S. 280.

The Court of Civil Appeals also upheld its Nov. 30 ruling, in which the court reinstated Trinity’s certificate of need and ordered Montgomery District Judge Jimmy Pool to rule in favor of Trinity, after he had earlier blocked the certificate of need.

Previously, Williams said Brookwood is challenging the Trinity move because Trinity opening the U.S. 280 hospital will “have a devastating effect on Brookwood Medical Center in the amount of $12 to $17 million per year.”
